Today’s TN Visa Applications Require Tactical Precision To Avoid Risk

It seems like President Trump’s recent executive order increasing scrutiny on all immigration applications has turned what were once more normal border crossings into potential traps for unsuspecting immigrants. This has been the case for some immigrants who have faced unforeseen, harsh realities while seeking to enter America. There are instances where U.S. border agents are now exercising extreme discretion, interpreting minor inconsistencies as potential visa fraud, and detaining applicants for extended periods. As will become clear from the experiences recounted below, this will be a source of particular concern for Canadian professionals seeking to enter the U.S. to take up a TN visa there, as well as for others with similar motives.

Some Examples Of What Is Happening On The Border

A few examples of what is happening on America’s borders illustrate the problem.

Recently, a French scientist was denied entry to the U.S. after border officials found private messages on his phone criticizing Donald Trump. He was detained, interrogated, and deported the next day, with officials citing possible links to terrorism. The incident, which occurred as he arrived to attend a scientific conference, has drawn condemnation from French authorities and sparked concerns over free speech, academic freedom, and digital privacy.

Germany recently updated its travel advisory for the U.S., emphasizing that a visa or entry waiver does not guarantee entry after several Germans were detained at the border. Similarly, Britain has also revised its advice for citizens travelling to the U.S., warning that those breaking entry rules could face arrest or detention.

Canadian film actress Jasmine Mooney, known for her role in American Pie, had a recent harrowing border experience. Attempting to renew her TN visa at the U.S.-Mexico border, she was not only detained but held for a shocking 12 days in a facility she described as “dehumanizing.”

Mooney recounted that she was shackled, slept on a mat with only a foil blanket, and endured a 24-hour transport ordeal crammed with 30 other women. Mooney was given no explanation for her detention. “I wasn’t charged with anything,” she told reporters, “but I was treated like a criminal.”

For many professionals—engineers, scientists, IT specialists, accountants, and consultants—these stories should be sounding alarm bells. Under the United States–Mexico–Canada Agreement (USMCA), the successor to NAFTA, Canadian citizens can apply for a TN visa to work in one of more than 60 designated professional categories in the U.S. But the landscape has changed. It’s also important to remember that under USMCA, the TN framework is reciprocal. Americans entering Canada under the same agreement face virtually identical requirements: proper documentation, confirmation of qualifications, and a clear demonstration that the role is temporary and falls within a listed professional category. The border may be shared, but the rules must be respected on both sides.

While the procedures differ from those of Mexican nationals (who must obtain a visa at a U.S. Consulate), Canadians benefit from a simplified process: they can apply for TN status directly at a U.S. port of entry without needing a visa foil in their passport. However, that simplicity belies the growing complexity of how applications are assessed in practice.

What to Avoid

Several pitfalls are now leading to increased denials—or worse:

Submitting inconsistent or incomplete documentation: Gaps in employment, mismatched job titles, or misaligned LinkedIn profiles can be enough to trigger suspicion.

Assuming past approvals guarantee future ones: Every TN application is reviewed anew. A previously granted TN status does not exempt an applicant from full scrutiny.

Misunderstanding what TN status is: Canadians often mistakenly believe they need a visa glued into their passport. In fact, TN status is granted at the border—it is not a physical visa document.

Implying permanent immigration intent: Language on social media profiles or job postings that suggests relocation or green card aspirations can run afoul of TN requirements, which demand a temporary employment purpose.

Applying at the U.S.-Mexico border: Officers at southern land borders are reportedly less familiar with Canadian TN applications and more likely to default to defensive measures.

What to Do

Professionals who take a careful and informed approach to TN applications can still be successful. The key is preparation and precision.

Apply at a U.S.-Canada land crossing or preclearance airport

Major Canadian airports with U.S. preclearance facilities (such as Toronto Pearson or Vancouver International) remain the most reliable places to apply. Officers there are experienced with the TN category and less likely to overreach.

Provide airtight documentation

A carefully drafted employer support letter should:

  • Clearly identify the TN occupational category.
  • Describe job duties in line with that category.
  • Emphasize the temporary nature of the employment.
  • State the salary that will be paid.

Bring original diplomas, transcripts, licenses (if applicable), and a résumé that aligns with your application materials.

Prepare for direct questioning

Officers may ask about job duties, work location, compensation, and qualifications. Be honest, consistent, and ready to explain your professional background in plain terms.

Apply at the border

While internal “change of status” applications through USCIS are allowed, they can be more susceptible to delays or denials—especially with increased scrutiny and since applicants don’t get the chance to speak in their own defence if an issue arises.

Consider Seeking Legal Advice

In today’s climate, even seasoned professionals are seeking the guidance of qualified immigration lawyers. A brief consultation can help identify red flags, refine documentation, and prepare applicants for questions they may face at the port of entry.

For those accustomed to the ease of past TN approvals, the shift may seem jarring. But as attorneys on both sides of the border will attest, the rules are the same—it’s the enforcement climate that has changed.

Conclusion: Border Crossings in a Post-2024 World

The TN work visa (and its American counterpart of professional work visa for Canada) remains one of the most powerful tools for cross-border professional mobility in North America. But in 2025, success requires a different mindset—one rooted in precision, strategy, and an appreciation of the current enforcement climate.

President Trump’s executive order has not rewritten the law, but it has reinvigorated the authority of border officers to apply it with a level of discretion not seen in years. Until the USMCA is changed in the future, Canadian professionals are advised to treat TN visa applications not as routine, but as significant legal engagements. The stakes are simply too high to assume anything less. American professionals would be wise to heed this same advice.
